Since all four members of DECAPITATED were charged on varying counts of kidnapping and rape on Oct. 13, information has now become available as to the set bail and following measures ordered by the judge.

The Spokesman-Review reports that when charges were read to members Wacław “Vogg” Kieltyka (guitar) and Mikola Lysejko (drums) on Oct. 12, Spokane Superior Court Judge Annette Plese set bail for each at $100,000 and ordered the members to surrender their passports and refrain from any contact with each other.

Kieltyka's attorney, Stephen Graham, maintains that the non-contact order is inhumane: "‘If they are kept apart they, in essence, will be held in solitary confinement,’ Graham said. ‘Because they don’t speak English very well,'" as reported by the Spokesman-Review.

At this time, the band have no criminal record in America, but their records in Europe have not been released yet.

As previously reported, all four members of the band were arrested following their Sept. 9 performance in Santa Ana, California, while on tour with Thy Art Is Murder. The charges vary between the four—Rafal Piotrowski and Waclaw Kieltyka have second-degree rape charges, while Mikola Lysejko and Hubert Wiecek have third-degree charges. Both members who appeared in court, Kieltyka and Lysejko, were charged with first-degree kidnapping.

The band maintain their innocence in a recent Facebook post following the charges.
